Terms and Conditions for HouseCaddy

AGREEMENT TO TERMS

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and House Caddy, LLC, (“we,” “us,” or “our”), concerning your access to and use of the House Caddy mobile application and any related services (collectively, the “App”).

You agree that by downloading, installing, accessing, or using the App, you have read, understood, and agreed to be bound by all of these Terms and Conditions.

IF YOU DO NOT AGREE WITH ALL OF THESE TERMS AND CONDITIONS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE APP AND YOU MUST DISCONTINUE USE IMMEDIATELY.

1. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the App “House Caddy”, is our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, graphics, and the trademarks, service marks, and logos contained therein (the "Content") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights.

2. USER REPRESENTATIONS

By using the App, you represent and warrant that:

  • You have the legal capacity and agree to comply with these Terms.
  • You will not use the App for any illegal or unauthorized purpose.
  • Your use of the App will not violate any applicable law or regulation.

3. USER REGISTRATION

You will be required to register with the App. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

4. DESCRIPTION OF SERVICES

House Caddy is a digital home management tool designed to assist you in tracking and managing various aspects of your homeownership. The specific services include, but are not limited to:

  • Home Maintenance Tracking: Logging and setting reminders for routine and ad-hoc home maintenance tasks (e.g., HVAC filter changes, gutter cleaning).
  • Appliance & System Inventory: Storing details, model numbers, and installation dates for home appliances and systems.
  • Warranty & Service Contract Tracking: Recording warranty periods, terms, and expiration dates for equipment and services.
  • Vendor & Supplier Directory: Allowing you to store contact information for contractors, repair services, and suppliers. Note: We do not endorse or guarantee the work of any vendor you add.
  • Tax Deadline Reminders: Providing functionality to set reminders for due dates related to property taxes and other home-related taxes.
  • Tax Mitigation Information: Offering general information, tips, and logs for potential tax deductions and credits related to home ownership, home offices, energy efficiency improvements, and rental property expenses.

5. PROFESSIONAL DISCLAIMER - IMPORTANT

THE APP PROVIDES TOOLS FOR INFORMATIONAL AND ORGANIZATIONAL PURPOSES ONLY. THE INFORMATION AND REMINDERS PROVIDED BY THE APP ARE NOT A SUBSTITUTE FOR PROFESSIONAL ADVICE.

No Financial or Tax Advice

The tax-related features, including reminders and mitigation information, are for general informational purposes only. We are not a licensed financial advisor, accountant, or tax attorney. You are solely responsible for consulting with a qualified professional regarding your specific tax situation and for verifying all tax deadlines and deduction eligibility. We do not guarantee any specific tax outcome.

No Endorsement of Vendors

The inclusion of vendors, contractors, or suppliers in your directory or any suggested list within the App does not constitute our endorsement, warranty, or guarantee of their services, quality, licensing, or insurance. You are solely responsible for vetting, selecting, and contracting with any service provider.

No Warranty on Information

We do not warrant the accuracy, completeness, or usefulness of any user-entered or third-party information. Any reliance you place on such information is strictly at your own risk.

6. USER GENERATED CONTRIBUTIONS

The App may allow you to upload data, text, photos, and other information ("Contributions"). You are solely responsible for your Contributions and affirm that you own or have the necessary rights to upload them. You retain any intellectual property rights you hold in your Contributions.

By uploading Contributions, you grant us an unrestricted, worldwide, royalty-free license to host, use, distribute, modify, run, copy, and store such Contributions solely for the purpose of operating, providing, and improving the App.

7. GUIDELINES FOR REVIEWS

If you post a review of a vendor or the App, you agree that:

  • Your review is based on your own firsthand experience.
  • Your review is not false, misleading, or fraudulent.
  • You have no affiliation with competitors or any financial incentive to post a negative review.

8. DATA AND PRIVACY

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms, explains how we collect, use, and protect the personal information you provide to us, including sensitive data about your home, finances, and vendors. By using the App, you consent to the data practices described in the Privacy Policy.

9. SUBSCRIPTION AND FEES

  • Free Tier: The App may offer a basic set of features at no cost.
  • Premium Tier: Access to advanced features (e.g., unlimited reminders, cloud backup, advanced tax tracking) may require a paid subscription ("Premium Tier").
  • Auto-Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it through your device's app store settings.
  • Payment: All payments are processed by the Apple App Store or Google Play Store. You agree to their respective terms and conditions. We do not store your payment card details.

10. CANCELLATION

You can cancel your subscription at any time through your app store account settings. Refunds are subject to the policies of the Apple App Store and Google Play Store. We do not grant refunds directly.

11. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the contents of the App at any time or for any reason at our sole discretion without notice. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the App.

12. GOVERNING LAW

These Terms shall be governed by and defined following the laws of Delaware, USA. You irrevocably consent that the courts of Lewes, DE, USA, shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

13. DISCLAIMER

THE APP IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE APP IS AT YOUR SOLE RISK. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14. LIMITATION OF LIABILITY

IN NO EVENT WILL WE, OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, OR DATA LOSS, ARISING FROM YOUR USE OF THE APP, even if we have been advised of the possibility of such damages. Our total cumulative liability to you for all claims related to the App shall not exceed the amount of one hundred dollars (USD $100.00) or the amount you have paid us in the last twelve months, whichever is greater.

15. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees, arising out of:

  • Your use of the App;
  • Your breach of these Terms;
  • Your failure to pay taxes or meet tax deadlines;
  • Any services provided by a vendor you selected using or listed in the App.

16. USER DATA

We will maintain certain data that you transmit to the App for the purpose of managing the App. While we perform regular backups of data, you are solely responsible for all data that you transmit. We are not liable for any loss or corruption of your data.

17. ELECTRONIC COMMUNICATIONS

By using the App, you consent to receive electronic communications from us, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communication be in writing.
